\u00e2mbito da Recupera\u00e7\u00e3o Judicial<br \/>\n(caso Americanas)Em nova decis\u00e3o acerca na recupera\u00e7\u00e3o judicial do Grupo Americanas, o juiz da 4\u00aa Vara Empresarial da Capital autorizou que sejam apresentados bens como garantia em diversos tipos de a\u00e7\u00f5es, em especial, as execu\u00e7\u00f5es fiscais.Apesar de o Art. 66 da Lei de Recupera\u00e7\u00e3o e Fal\u00eancia n\u00e3o permitir a disposi\u00e7\u00e3o e aliena\u00e7\u00e3o de bens para empresas em recupera\u00e7\u00e3o judicial, o magistrado entendeu que o Grupo Americanas demonstrou a necessidade\/utilidade da medida autorizada, j\u00e1 que tal procedimento permitir\u00e1 que haja defesa em executivos fiscais e a obten\u00e7\u00e3o de CNDs para a restitui\u00e7\u00e3o em dinheiro de cr\u00e9dito de PIS\/COFINS de aproximadamente R$ 97.6 milh\u00f5es.<\/p>\n<p>Na decis\u00e3o, o juiz pontuou que em determinadas situa\u00e7\u00f5es a aliena\u00e7\u00e3o\/onera\u00e7\u00e3o de
